Terms and Conditions

1. I accept that by accessing the NETS software program I am now a client of NETS Traders IT Pty Ltd. and I give permission to be contacted by NETS Traders IT Pty Ltd in the future by one or all of my supplied contact details.
2. I accept that the information collected from clients is considered confidential. NETS Traders IT Pty Ltd will under no circumstances disclose, publish or sell personal information gathered from clients, to any individual or company, at any time without the written consent from that client unless instructed to by way of state or federal law.
3. I accept that to use NETS software program there is a fee to be paid per month. This fee may alter in the future. All clients will be advised before such increases take effect.
4. I accept that the method of payment is by cheque, money order or direct deposit into the NETS Traders IT Pty Ltd bank account. Late payments are given a four day grace period, after that access to the NETS software program will not be granted until the payment has been made. A late fee may also apply.
5. I accept that NETS Traders IT Pty Ltd has full right and exclusivity to access, use, grant its clients access to the NETS software program and its relative contractors and owners. In relation to the NETS software program and any of its parts or included data I understand it is strictly forbidden (whether I am a Licensed user or not) to:
   1. Reproduce, copy, discover or modify or merge the source code.
   2. Reverse compile, remove, alter or obscure any part of the software, including the tampering with or breaching of intellectual property.
   3. Hack into the NETS or NETS Traders website server or related systems or to allow any form of access by unregistered users to the software or its related parts or its included data.
   4. Create derivative works of the software without permission of NETS Traders IT Pty Ltd.
   5. Lend, sub-lease, rent or lease to any person any portion of the software or derivative thereof.
   6. Export any of the included data in any form including soft copy to another party
   7. Use any of the included data in any other platform other than its intended platform, i.e. the NETS software program.
6. I accept the NETS software program is not for public display nor is it public domain. It must not be used in any way to educate non NETS Traders IT Pty Ltd clients on how to trade, how to use the NETS program or decipher the ASX stock market data unless given specific written permission from NETS Traders IT Pty Ltd. The licensed user of the NETS software program may purely for private promotional purposes, show or demonstrate the program to small numbers of people or prospective users in their own homes or small private gatherings. Any other form of promotion must have the approval of NETS Traders IT Pty Ltd in writing.
7. I accept that;
   1. The licensed user must not advertise the NETS software program or the data contained within the program via any form of printed, audible or visible form of advertising or promotion.
   2. Reproduction to distribute, distribution or any form of on-selling of the NETS Traders IT Pty Ltd website or NETS or its contained data in any shape or form is strictly forbidden and will result in legal action.
   3. The Licensed user understands that the NETS software program produces reports that are designed to be customized by the Licensed user. These are by no means considered buy or sell lists nor are they recommendations to any action. The reports are for Licensed private use only. A Licensed user must make their own trading decisions from the information that is available to them.
   4. Any licensed user of the NETS software program may save, print or store copies of reports of the NETS software program containing ASX data for their own personal use, including business partners, trading partners, small private trading groups of other NETS software program licensed users and family members but must not redistribute copies in any form such as snapshots, printouts, reports of the NETS software program or its contained data in any form via any delivery format, mediums or means for any advertising, to any deemed competitor of NETS Traders IT Pty Ltd (at our discretion), to any web based medium such as a website, chat room, blog, email or similar for whatever purpose.
   5. The Licensed user of the NETS software program must instantly inform NETS Traders IT Pty Ltd of any breach of the terms listed in this document.
   6. The licensed user accepts and understands that the NETS software program only displays End Of Day figures or delayed information. The NETS software program does not display real time information. Any link to another platform that does deliver real time information is separate to the NETS software program and NETS Traders IT Pty Ltd will take no liability or warranty for any information displayed in linked or unlinked websites displayed on the licensed user.s computer or device.
8. I accept that the registered user(s) of the NETS software program is as stated on the contact form listing authorized users and is the sole acceptable user(s).
9. I accept that the license to use the NETS software program may not under any circumstances be passed on or assigned to, other users.
10. I accept that only one computer, laptop, web access device or the like, may use the unique user name and password and thus access the NETS software program at a time.
11. I accept that NETS Traders IT Pty Ltd believes the information contained in the NETS software program and related instructions, paperwork, payment processing or accounts is accurate and reliable, but no warranty (either expressed or implied, but not limited to) accuracy, reliability, merchantability or fitness for a particular purpose is given and no responsibility arising in any other way for errors or omissions (including responsibility to any person by reason of negligence) is accepted by NETS Traders IT Pty Ltd or affiliates.
12. I accept that the NETS software program may require maintenance and/or upgrading from time to time and I exonerate NETS Traders IT Pty Ltd from any liability related to the NETS software program being inaccessible for any period.
13. I accept and understand that NETS Traders IT Pty Ltd does not recommend, own, endorse or receive money from any stock broking firm or advisor.
14. I accept to release NETS Traders IT Pty Ltd from any negligence claim related to the use of the NETS software program should it affect my personal computer, laptop or other web based electronic device.
15. I accept that NETS Traders IT Pty Ltd reserves the right to exclude access to its databases, the NETS software program or other related software to users and/or clients at its own discretion.
16. I accept and understand that the NETS Traders Web site and/or NETS software program may point to other Internet sites that could be of interest.
17. I accept and understand that NETS Traders IT Pty Ltd does not endorse or take responsibility for the content, accuracy of data, accessibility, site construction or navigation on such other linked sites. Nor does it guarantee the availability, accuracy of, or endorse the views and/or opinions of the sites and/or their related companies, businesses, employees or contractors.
